The Kentucky Supreme Court continues to investigate the Internet gambling case from iMEGA, a company who is in a court battle over domain names. This case still stands strong in court, pending a decision as to whether they owned the name, or seized it from another company. This legal name battle began in March of 2010 when the state of Kentucky asked iMEGA to present proof that one of their clients was using the name. They presented Yatahay Limited, the owner of TruePoker.com who swore on an affidavit to show that they were legally members of iMEGA.

Pending a Supreme Court decision, Kentucky filed another charge against Pocket Kings, who run Full Tilt Poker. Later, on the 11^th of August, 2010, they filed changes and also added PartyGaming, another site’s activities prior to the point in 2006 when they stopped providing gambling online services to Americans.

Why include PartyGaming in their suit? Some people argue that they have an inside deal to settle with the Federal Department of Justice, resulting in a milder point of focus or discipline for the state. Also, PartyGaming is a large company that has shareholders and may be seen as more credible and easier to sue than smaller, unknown companies.  In fact, two of the largest shareholders named Russ de Leon and Ruth Parasol will not settle with the state for their individual involvement in online gambling activity – the state of Kentucky may be trying to pressure them. iMEGA head Joe Brennan feels that the government may find PartyGaming to be an easy target because they are about to merger with another gambling company.

Lawyers for Kentucky’s government (a frim named Hurt Crosbie and May) notified CEO Jim Ryan of PartyGaming that there is an upcoming lawsuit based on activity up to October 2006. Under the law in Kentucky state, online gambling transactions are illegal and the state is allowed to recover these losses for its citizens. There has been no comment from the head of PartyGaming, although Jim Ryan has officially said he sees no challenges to getting the proper license once the government puts together market regulations.

Unlike Party Gaming, Pocket King still operates in the States and is a large part of the Poker Player’s Alliance who are trying to stop legislation against online gambling.

In a world where everything is moving the online space for revenue, governments are using casino revenue to enhance their profits, too. In eastern Canada, mainly Ontario, and western Canada, mainly British Columbia, governments are looking at raking in money with Internet gambling.

Ontario’s finance minister, Dwight Duncan, told the press last week that Ontario plans to spend the next year and a half developing a program to implement in 2012. Originally, Duncan’s thought was the merge Crown corporations into one, selling parts of the company as shares to private investors has stalled due to unions and stagnant wages. Sociologists claim that for youth – who use the internet more than any other group –  these gaming websites would be detrimental. Playnow.com is an example of a British Columbia site made by the government; Quebec plans to release the second Eastern Canadian government gaming site soon. Online poker rooms may soon become legal in the United States. If things go well and the Internet Gambling Regulation, Consumer Protection, and Enforcement Acts pass through Congress to finally become a law, online poker rooms will be able to seek licenses to operate in USA.

H.R. 2267 (Internet Gambling Regulation, Consumer Protection, and Enforcement Act) is limited in its scope. According to this act, any business, organization or entity found guilty of breaking federal gambling laws will not be eligible to seek licenses. PokerStars has also appealed for the same reason. They are now pushing the fact that they have not broken any state or federal gambling law that could prevent them from receiving a license to operate poker rooms in the United States in case H.R. 2267 is finally passed by the Congress.

According to a recent statement from PokerStars, its activities in USA have always been lawful, and the same is indicated by the legal opinions provided to the company. If the proposed H.R. 2267 becomes a law, a company should not be prevented from acquiring a license to operate poker rooms in United States.

Once PartyPoker pulled out of the US market and Safe Port Act was no more, PokerStars gained immense popularity. Two Historic Race Tracks Open for 2010 Season This Week

Del Mar, California and Saratoga Springs, New York are known for offering the best action in horse racing.  They are also the two most historic race tracks in the USA and have the privilege of opening the new 2010 season.  Del Mar’s season starts on Wednesday, while Saratoga’s is on Friday.

The Del Mar racetrack opened in 1937 and had its first major race win in the race between Seabiscuit and Ligaroti, which was a ‘winner take all’ race.  NBC radio broadcast the race making it the very first national radio race broadcast in history.  The race gained a lot of publicity even though horse racing was less popular than baseball at the time.
